01Who these terms are between
These terms are between Digisurge Pty Ltd (ABN 14 647 066 368), called "Digisurge", "we" or "us", and the business that signs up, called "you". By paying for a subscription you agree to them on behalf of your business.
Digisurge is for businesses. You must be able to enter into a contract for your business, and to register a .com.au domain you need an Australian Business Number or other eligibility under auDA rules.
02What we provide
For as long as your subscription is active we provide:
- a website designed and built for your business, using the answers, files and photos you give us
- registration of one .com.au domain in your business name, or connection of a domain you already hold
- a logo and brand pack: logo options to choose from, then guidelines, colours and vector files for the logo you choose
- hosting in Australia, HTTPS and security and malware protection for your site
- an AI assistant in your account that makes changes to your site when you ask
- a GST tax invoice for every payment
Your site is built by AI (Claude, a model made by Anthropic) working to our quality rules. While we launch, a person at Digisurge reviews each site before it goes live.
03Price, billing and GST
Your first month costs $14. Each month after that costs $59. All prices are in Australian dollars and include GST.
We charge the card you sign up with at the start of each monthly billing period, starting on the day you sign up. If a payment fails we will tell you and try again. If it still fails we may pause your site until the account is paid.
We will give you at least 30 days' notice by email before any change to the monthly price.
04No preview before payment
Every site is designed from scratch, and that work only starts after you pay. We do not show designs before payment, and there is no free plan or free trial. The showcase on this website shows examples of our work for fictional businesses.
05Your site is hosted on Digisurge only
Your website is built for and hosted on the Digisurge platform. It cannot be exported, downloaded as code or moved to another host or website builder, during your subscription or after it ends.
We tell you this on this website, in these terms and again at checkout, where you confirm you understand it before you pay.
06What is yours
- Your domain. It is registered to your business. If you leave, you can transfer it to another registrar, following the usual auDA transfer process.
- Your brand pack. Once you choose a logo, the logo files, colours and guidelines in your brand pack are yours to use anywhere, including after you leave.
- Your content. Words, photos and files you give us remain yours. You give us permission to use them to build, host and change your site.
The design, code and platform that make up your website belong to Digisurge and are licensed to you for as long as your subscription is active.
07Changes through the assistant
You can ask the assistant to change your site at any time. It acts on your instructions, so please check changes once they are published. If a request would break these terms or our acceptable use policy, the assistant may decline it.
Changes are included in your plan. We may set fair use limits if a request pattern is far outside normal use for a small business website, and we will tell you before any limit applies.
08Cancelling
You can cancel at any time from your account or by emailing us. Your site stays live until the end of the billing month you have paid for, then it is taken offline. We do not charge a cancellation fee.
Part months are not refunded, except where the Australian Consumer Law requires it.
09Your responsibilities
- Give us accurate information about your business, and keep it up to date.
- Only give us content you have the right to use.
- Make sure claims on your site, such as prices, licences and guarantees, are true.
- Follow our acceptable use policy.
- Keep your account sign-in secure.
10Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Where the law allows, our total liability to you for any claim related to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect losses such as lost profits, except where the law says otherwise.
11Suspending or ending the service
We may suspend or end your subscription if you do not pay, if you seriously or repeatedly break these terms or our acceptable use policy, or if the law requires it. Where it is reasonable, we will warn you first and give you a chance to fix the problem.
12Changes to these terms
We may update these terms. We will email you at least 30 days before a change that affects you, and the date at the top of this page will change. If you do not agree to the new terms you can cancel before they apply.
13Governing law
These terms are governed by the laws of the Australian state or territory where Digisurge Pty Ltd is registered, and you and we accept the jurisdiction of its courts.
